Terms of Use
These terms govern your use of the Sudoku Samurai mobile app, this website, and any in-app purchases. Please read them carefully. By installing or using the app, or by browsing this site, you agree to be bound by them.
Last updated:
1. Who provides the service
Sudoku Samurai (“Sudoku Samurai”, “we”, “us”) is provided by Lucas Howlett, an independent developer. The mobile app is distributed through the Apple App Store and Google Play. The website is published at https://sudoku-samurai.app.
You can contact us at lucas@lucashowlett.com.
2. The licence we grant you
We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use Sudoku Samurai on devices that you own or control, for your personal non-commercial entertainment, in accordance with these terms and the applicable App Store or Google Play terms.
You agree that you will not:
- Copy, modify, translate, decompile, disassemble, or reverse engineer the app, except to the limited extent expressly permitted by law.
- Sell, rent, sublicense, distribute, or commercially exploit the app or any of its content.
- Remove or alter any copyright, trademark, or other proprietary notices.
- Use the app to infringe the intellectual property of others or to violate any law.
- Attempt to circumvent payment, technical protection measures, or in-app purchase entitlements, or use the app on a jailbroken or rooted device in a way that bypasses such protections.
- Interfere with or disrupt the integrity, performance, or security of the app or any related service.
3. App stores
Your download and installation of the app are also governed by the terms of the platform you use:
- The Apple Media Services Terms and Conditions, including the Licensed Application End User Licence Agreement (“Apple EULA”), apply when you obtain the app from the Apple App Store. To the extent these terms differ from the Apple EULA, the Apple EULA prevails for App Store downloads.
- The Google Play Terms of Service apply when you obtain the app from Google Play.
You acknowledge that the App Store and Google Play are not parties to these terms but are intended third-party beneficiaries with the right to enforce them as relates to the licence granted to you.
4. In-app purchases
Sudoku Samurai offers an optional one-time in-app purchase that unlocks the full version of the game (“Full Game”). Unlocking the Full Game grants access to features such as unlimited Samurai Sudoku, the complete campaign across all regions, and personal stats and best times. The exact features included may evolve over time, but the Full Game is provided as a one-time purchase rather than a subscription.
How payment works. All in-app purchases are charged to your Apple ID or Google account by Apple or Google, not by us. Purchases are processed through their billing systems and are subject to their policies. Receipt validation is performed by our processor RevenueCat.
Pricing and currency. Prices are shown in your local currency on the in-app purchase screen and on the App Store or Google Play product page. Prices may change from time to time, but a confirmed purchase will not be re-charged. Applicable taxes are added by Apple or Google where required by law.
Restoring purchases. If you reinstall the app or use a new device, you can recover the Full Game by tapping “Restore Purchase” on the unlock screen. Restoring works on the same Apple ID or Google account that originally made the purchase.
Refunds. Refunds for in-app purchases are handled by Apple and Google in line with their published policies. We do not process refunds directly. To request a refund:
- On iOS, visit reportaproblem.apple.com.
- On Android, follow Google’s refund instructions in the Google Play Help Center.
Where you have a statutory right of cancellation under consumer-protection laws (for example, the 14-day right of withdrawal under EU and UK consumer law), you acknowledge that digital content delivered immediately and at your request loses that right once delivery has begun, except as required by your local law. None of these terms limit any non-waivable consumer rights you may have.
No subscription. The Full Game is a one-time purchase. There is no recurring billing, no auto-renewal, and no cancellation step is required.
5. Free version
Some content in the app is available without purchase. We may change which features are available for free, change difficulty limits, or replace free content over time. We will not remove features that you have specifically paid to unlock.
6. Updates and changes
The app may install updates automatically through the App Store or Google Play. We may add, change, or remove features, content, or functionality at any time, including features that are not part of an in-app purchase entitlement. We will not, however, remove or substantially diminish features that you have paid to unlock through an in-app purchase, except where required for legal, security, or technical reasons.
7. Your account and your device
The app does not require you to create an account with us. Your progress, statistics, and settings are stored on your device. You are responsible for safeguarding your device, your Apple ID or Google account, and any backups they create. We are not responsible for loss of game progress that results from device failure, loss, theft, deletion, or unauthorised access.
8. Intellectual property
The Sudoku Samurai name, logo, branding, mascots, calligraphy, source code, puzzle generators, audio, illustrations, and other creative material are owned by Lucas Howlett or our licensors and are protected by copyright, trademark, and other laws. Nothing in these terms transfers any of those rights to you.
Sudoku itself is a public-domain logic puzzle. We claim no ownership of the rules of sudoku.
9. Feedback
If you send us feedback, suggestions, or ideas about the app or the website, you grant us a perpetual, worldwide, royalty-free licence to use them without obligation to you. You should not send us any information you consider confidential.
10. Acceptable use of the website
When using this website, you agree not to use it in a way that could damage, disable, overburden, or impair it; not to attempt to gain unauthorised access to any part of it; and not to use automated means to scrape or extract content beyond what is permitted by the site’s robots.txt.
11. Disclaimer of warranties
The app and the website are provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
Some jurisdictions do not allow the exclusion of certain warranties, in which case those exclusions may not apply to you.
12. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, goodwill, or other intangible losses, arising out of or relating to your use of the app or the website, even if we have been advised of the possibility of such damages. Our aggregate liability for any claim arising out of or relating to these terms or the service is limited to the greater of (a) the amount you paid us through in-app purchases in the twelve months before the event giving rise to the liability, or (b) ten US dollars (USD 10).
Nothing in these terms limits or excludes any liability that cannot be limited or excluded under applicable law, including liability for death or personal injury caused by negligence or for fraud.
13. Indemnity
You agree to indemnify and hold harmless Lucas Howlett and Sudoku Samurai from any claim, demand, loss, or expense (including reasonable legal fees) arising out of your breach of these terms or your misuse of the app or the website.
14. Termination
You may stop using the app at any time by uninstalling it. We may suspend or terminate your access to the app or the website if you breach these terms or use the service in a way that causes legal, security, or technical risk. The clauses that by their nature should survive termination will survive, including the sections on intellectual property, disclaimers, limitation of liability, indemnity, and governing law.
15. Changes to these terms
We may update these terms from time to time. The “Last updated” date at the top reflects the most recent revision. If we make a material change, we will give reasonable notice in the app or on the website before it takes effect. Continuing to use the service after a change takes effect means you accept the updated terms.
16. Governing law and disputes
These terms are governed by the laws of the jurisdiction in which the developer ordinarily resides, without regard to its conflict-of-laws rules. The courts of that jurisdiction will have exclusive jurisdiction over any dispute arising out of or relating to these terms or the service. This does not deprive you of the protection of any mandatory consumer-law rights of the country where you are habitually resident.
17. Apple-specific notice
For users who download the app from the Apple App Store, the following also applies. These terms are between you and us only, not with Apple. Apple is not responsible for the app or its content. To the maximum extent permitted by law, Apple has no warranty obligations with respect to the app. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price you paid for the app, if any. Apple is not responsible for addressing any claims you have relating to the app, including product-liability claims, claims that the app fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer-protection or similar legislation. Apple is not responsible for the investigation, defence, settlement, or discharge of any third-party intellectual-property claim regarding the app. You represent that you are not located in a country subject to a United States Government embargo, or that has been designated by the United States Government as a “terrorist supporting” country, and that you are not on any United States Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
